Description:On July 31, 1984, the U.S. Environmental Protection Agency (EPA) proposed a requirement for owners and operators of affected facilities subject to opacity standards in 40 CFR Part 60 to conduct opacity observations, and record and report the opacity of emissions during each performance test. This requirement was proposed under the authority of Section 114 of the Clean Air Act, as amended, and was based on the Administrator's determination that the recordkeeping and reporting was necessary to demonstrate compliance with the respective opacity standards. The data would also be used during 4-year reviews of standards of performance for new stationary sources so that EPA could decide whether revisions to the respective opacity standards were necessary. The proposed opacity provisions were published in the Federal Register (49 FR 30676) with a request for public comments. The opportunity for a public hearing was provided but a hearing was not held because it was not requested. A total of 19 comment letters were received from industry, state and local air pollution control agencies, and a law firm representing members of the Utility Air Regulatory Group (UARG). The comments that were submitted, along with responses to these comments, are summarized in this document.
