Upon the several points, that the entire plan and scope of the will involves survivorship; that the direction for a sale of the property at a point of time subsequent to two life estates, not of the same, but of succeeding generations, and a distribution at such time among those of a class wherein the idea of survivorship is conveyed by expressly excluding those who had died leaving issue; upon the ground that the beneficiaries of the fund were a class determinable only at the point of time of the distribution, and were beneficiaries of a power in trust: that the income payable to these beneficiaries was at no time income of separate shares, and that there is no relation between the division of the income and the corpus of the estate: and that all decisions cited, apparently in conflict with the opinion of the Appellate Division, are either concerning-devises or legacies to individuals in-which the idea of survivorship is excluded actually or by implication: the judgment upon the determination of the Appellate Division of the Supreme Court should be affirmed, with costs to the respondents, payable from the income of the estate.
